DIGITAL RENTAL AGREEMENT

This Digital Rental Agreement (“Agreement”) is made and executed electronically through Jipangishe App, a digital property marketplace and payment facilitation platform operated by Jipangishe Agency Company Limited, in accordance with the laws of the United Republic of Tanzania.

By clicking “I AGREE” and completing payment of rent through Jipangishe App, the Tenant confirms that they have read, understood, and fully accepted all terms and conditions of this Agreement.

1. PARTIES

This Agreement is entered into between:
• The Property Owner or Landlord, who has listed the property on Jipangishe App; and
• The Tenant, who has selected the property and is ready to pay rent through Jipangishe App.
Both parties are digitally identified and verified within the Jipangishe App system.

2. PROPERTY

This Agreement applies to the residential or commercial property listed and selected within Jipangishe App, including its location, category, and description as displayed in the App at the time of selection.

3. RENTAL TERM

The rental period shall officially commence on the date on which rent payment is confirmed within Jipangishe App and shall continue until the rental end date as specified and displayed within the system prior to the Tenant’s confirmation of the property and initiation of the payment process.

4.RENT AND PAYMENTS

  • All rent and any related charges shall be paid electronically through Jipangishe App.
  • Confirmation of rent payment constitutes lawful reservation and/or occupation rights for the agreed rental period.
  • Any payments made outside Jipangishe App shall be deemed outside the scope and responsibility of Jipangishe Agency Company Limited.

5. CANCELLATION AND NO-REFUND POLICY

  • Once rent has been paid and confirmed through Jipangishe App, such payment shall be strictly non-refundable.
  • Cancellation, early termination, non-occupation, abandonment, or relocation by the Tenant shall not entitle the Tenant to any refund.
  • Rent paid shall remain valid for the full duration of the rental period until this Agreement expires, unless otherwise required by applicable law.

6. PROPERTY DAMAGE AND RESTORATION

Violation of these Terms will result in immediate suspension of your license and may lead to:

  • The Tenant shall be fully responsible for any damage, loss, or destruction caused to the property, fixtures, fittings, furniture, or related assets during the rental period, except for fair wear and tear.
  • The Tenant shall be liable to pay the full cost of repair, replacement, or restoration of any damaged property.
  • Upon termination or expiry of this Agreement, the property shall be returned in the same condition as at commencement, subject only to reasonable wear and tear.
  • Failure to restore the property or compensate for damages may result in legal action.

7. TENANT OBLIGATIONS

The Tenant agrees to: :

  • Use the property solely for lawful purposes;
  • Pay rent and applicable charges on time;
  • Maintain the property responsibly;
  • Avoid unauthorized alterations or misuse;
  • Not sublet, assign, or transfer occupancy without the Landlord’s consent.

8. LANDLORD OBLIGATIONS

The Landlord agrees to: :

  • Deliver the property in habitable and usable condition;
  • Respect the Tenant’s right to quiet enjoyment;
  • Carry out major structural repairs not caused by the Tenant’s negligence or misuse.

9. SERVICE FEE DEDUCTION

Before proceeding with the rental or payment request, please read the important terms below:

  1. The Tenant expressly acknowledges and agrees that fifty percent (50%) of one (1) month’s rent shall be deducted as a non-refundable service fee for the use of Jipangishe App and its related services.
  2. The remaining balance shall constitute the official rent applicable for the entire rental period under this Agreement.
  3. The service fee is separate from rent payable to the Property Owner and shall be deemed earned immediately upon successful payment.
  4. The service fee shall not be refundable under any circumstances.

10. TERMINATION

  1. This Agreement shall automatically terminate upon expiry of the rental period unless renewed by mutual agreement.
  2. Termination prior to expiry shall not affect the no-refund or service fee provisions of this Agreement.

11. RENEWAL AND SUBSEQUENT AGREEMENTS

  1. Upon expiry of this Agreement, the Tenant and the Property Owner may, by mutual consent, renew the tenancy or enter into a new rental agreement.
  2. Any renewal or subsequent agreement entered into after expiry shall be separate and independent from this Agreement.
  3. Jipangishe Agency Company Limited shall bear no responsibility, liability, or involvement in any agreement entered into after expiry.

12. PLATFORM ROLE DISCLAIMER

Jipangishe App acts solely as:

  1. A digital property listing and booking platform;
  2. A payment facilitation and electronic record-keeping system.

Jipangishe Agency Company Limited is not a party to the tenancy relationship and shall not be liable for disputes, losses, or claims arising between the Landlord and the Tenant.

13. TENANT ELIGIBILITY AND QUALIFICATIONS

  1. The Tenant represents and warrants that they are of legal age, legally competent, and have full legal capacity to enter into this Agreement.
  2. The Tenant confirms that all information provided within Jipangishe App is true, accurate, complete, and up to date.
  3. The Tenant agrees to comply with all applicable laws, regulations, and community rules.
  4. The Tenant shall not use the property for any illegal, immoral, or unlawful activities.
  5. Any false representation or breach of eligibility shall constitute a material breach and may result in immediate termination without refund.

14. TENANT RIGHTS

Subject to compliance with this Agreement and applicable law, the Tenant shall have the right to:

  1. Receive the property in a habitable and usable condition;
  2. Submit complaints or concerns through Jipangishe App procedures;
  3. Quiet enjoyment of the property without unlawful interference;
  4. Access essential services as disclosed at the time of selection;
  5. Accurate and transparent information prior to payment;
  6. Respectful and non-discriminatory treatment;
  7. Protection of personal data in accordance with applicable laws;
  8. Occupy the property until expiry of this Agreement.

15. NOTICE TO VACATE AND PROPERTY INSPECTION

  1. The Tenant shall notify Jipangishe App in advance of their intention to vacate, relocate, or move out of the property, in accordance with procedures provided within the App.
  2. Upon such notice, Jipangishe App shall facilitate, record, or verify a property condition inspection to confirm that the property is returned in good condition, subject to fair wear and tear.
  3. The Tenant agrees to fully cooperate with the inspection process, including granting reasonable access for assessment and documentation.
  4. Any damage identified shall be handled in accordance with Clause 6 (Property Damage and Restoration).
  5. Failure to notify Jipangishe App prior to vacating shall constitute a breach of this Agreement and may result in liability for resulting loss or damage.

16. DISPUTE RESOLUTION

Any dispute arising out of or in connection with this Agreement shall first be resolved amicably. Failing such resolution, the dispute shall be referred to the competent legal authorities of the United Republic of Tanzania.

17. ELECTRONIC ACCEPTANCE, PAYMENT, AND LEGAL EFFECT

By clicking “I AGREE” and paying rent through Jipangishe App, the Tenant confirms that:

  • They voluntarily accept all terms and conditions of this Agreement;
  • Such electronic acceptance together with payment constitutes a valid, binding, and enforceable digital signature and agreement;
  • This Agreement is enforceable under the electronic transaction laws of the United Republic of Tanzania.
